Who these terms are with

This website is operated by North Wave Plumbing, trading as North Wave, of North Vancouver, British Columbia, Canada. In these terms, "we", "us" and "our" mean North Wave; "you" means anyone using this website.

By using this site you accept these terms. If you do not accept them, please do not use it.

Using this website

You may use this site to read about what we do, to look up how to reach us, and to send us an enquiry. You agree to use it lawfully and not in a way that interferes with anyone else's use of it.

You must not:

• Use the site for any unlawful or fraudulent purpose.
• Send false, misleading or impersonating information through the contact form.
• Attempt to gain unauthorised access to the site, its hosting, or any system connected to it.
• Introduce any virus, malware or other harmful code.
• Scrape, harvest or systematically extract content or contact details from the site, including for marketing lists.
• Use the site in a way that damages, disables or overloads it.

Our content

The text, photographs, layout, graphics and code on this site belong to North Wave or to our licensors, and are protected by copyright and trade mark law. The North Wave name and logo are ours.

You may read the site, print pages for your own reference, and share links to it. You may not copy, republish, sell or reuse our content commercially without our written permission.

Accuracy of information

The guidance on this site, including anything in our blog about boilers, tankless units, hydronic heating, pool heating and plumbing, is general information written for a North Shore audience. It is not advice for your particular system, and it cannot be, because we have not seen it.

Every property is different. Do not rely on anything here as a substitute for having a licensed gas fitter or plumber look at the actual installation. Where a fault involves gas, water or heat, get someone qualified to it.

We keep the site as accurate and current as we reasonably can, but we provide it on an "as is" basis and do not warrant that it is complete, current or error-free.

Enquiries, quotes and contracts

Sending an enquiry through this site does not create a contract and does not book a visit. It starts a conversation. Nothing is booked until we have confirmed it with you directly.

Prices, timescales and service descriptions on this site are indicative and may change. A quote is only binding once we have given it to you in writing for your specific job, and it is subject to whatever conditions that quote sets out. Where a job turns out to need work the quote did not cover, we tell you and re-quote before doing it.

Any work we go on to carry out is governed by the terms of that written quote, not by this page.

Emergency calls

We answer emergency calls around the clock, and the phone number on this site is the way to reach us for one. Please do not use the contact form for an emergency, because form submissions travel by email and may not be seen straight away.

If you smell gas, leave the building first and call FortisBC's 24-hour emergency line on 1-800-663-9911 or the fire department. If water is flooding a property, shut off the main supply if you can safely reach it. Then call us.

Availability of the site

We aim to keep this site available, but we do not guarantee it. It may be unavailable during maintenance, or because of something outside our control at our host or on the network. We may change, suspend or withdraw any part of it without notice.

Third-party links and services

This site links to third-party services, including our Google Business Profile, our Instagram page, and an embedded Google Map. We do not control those services and are not responsible for their content, availability or practices. A link is not an endorsement.

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under British Columbia or Canadian law. Your statutory rights as a consumer are not affected.

Subject to that, to the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss arising from your use of this website, including lost profit, lost data, or loss arising from action you took on the strength of general information published here rather than on advice about your own system.

This section is about the website. Liability for work we actually carry out is dealt with in the written quote for that work and by our insurance as a licensed trade.

Your responsibility

You are responsible for the accuracy of what you send us. Getting a quote right depends on the make, model, age and symptom you describe, and a quote based on wrong details may need to change once we see the system.

You are also responsible for having a suitable device and internet connection to use this site, and for keeping your own systems secure.

Privacy

Our Privacy Policy explains what personal information this site collects and how we handle it. It forms part of these terms, so please read it alongside this page.

Changes to these terms

We may update these terms from time to time. The current version is always the one on this page, with the date it was last revised shown at the top. Continuing to use the site after a change means you accept the updated terms.

Governing law and disputes

These terms, and any dispute arising out of them or out of your use of this website, are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there.

You and we agree to submit to the exclusive jurisdiction of the courts of the Province of British Columbia. If you are a consumer resident elsewhere in Canada, this does not deprive you of the protection of any mandatory consumer law of your own province.

Before anyone goes near a court, please contact us. Most things are settled with a phone call.

General

If any part of these terms is found to be unenforceable, the rest continues to apply. If we do not enforce something straight away, that is not a waiver of our right to enforce it later. These terms are between you and us, and no one else can enforce them.
